Terms of Service

You must be at least 18 years old and able to enter into a binding agreement to use FairFyn. If you use FairFyn on behalf of a firm or organization, you confirm that you are authorized to accept these Terms for it.

FairFyn is software that gives a tax firm a branded, secure portal to work with its own clients. Features include two-way document exchange, return-status tracking, messaging, notifications, branded client login, and firm subscription billing through Stripe.

FairFyn does not prepare tax returns, does not provide tax, legal, or financial advice, and is not a party to the relationship between a firm and its clients.

A firm is responsible for its own clients, for the client and tax information it processes through FairFyn, and for the tax services it provides. Firms are responsible for obtaining any consents required to invite and work with their clients.

You are responsible for keeping your login credentials secure and for all activity under your account. Notify us promptly if you believe your account has been compromised.

You agree to use FairFyn only for lawful purposes and in line with these Terms. You agree not to misuse the service, including by attempting to access data that is not yours, disrupting the service, uploading malicious code, or using FairFyn to violate the rights of others or any applicable law.

FairFyn is a software tool only. It is not a tax preparer and does not provide tax, legal, accounting, or financial advice. FairFyn does not review, verify, or prepare any return or filing.

The tax firm is solely responsible for all tax services, advice, filings, and outcomes for its clients. Any reliance on the firm's work is a matter between the firm and its client. Nothing in FairFyn creates a professional advisory relationship between you and Kesava LLC.

FairFyn offers a free tier and paid subscription plans for firms. Paid plans are billed through Stripe on a monthly or annual basis and renew automatically until cancelled.

You can cancel at any time, and your plan will remain active through the end of the current billing period. Fees already paid are generally non-refundable except where required by law. We will give notice of material changes to pricing.

FairFyn, including its software, design, and branding, is owned by Kesava LLC and protected by law. We grant you a limited, non-exclusive, non-transferable right to use the service under these Terms.

Your data, and a firm's own branding and content, remain yours. You grant us the limited rights needed to host and operate the service on your behalf.

FairFyn is provided "as is" and "as available", without warranties of any kind, whether express or implied, to the fullest extent permitted by law. We do not warrant that the service will be uninterrupted or error free.

To the fullest extent permitted by law, Kesava LLC will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of data, revenue, or profits, arising from your use of the service. Our total liability for any claim relating to the service is limited to the amount you paid us for the service in the twelve months before the claim.

You agree to indemnify and hold harmless Kesava LLC from claims, damages, and expenses arising out of your use of FairFyn, your content or data, your tax services, or your violation of these Terms or of any law or third-party right.

You may stop using FairFyn at any time. We may suspend or terminate access if you breach these Terms, if required by law, or to protect the service and its users. On termination, your right to use the service ends, and we will handle your data as described in the Privacy Policy.

These Terms are governed by the laws of the State of Florida, USA, without regard to its conflict of laws rules. Any dispute will be handled in the courts located in Florida, unless applicable law requires otherwise.

We may update these Terms as FairFyn evolves or as legal requirements change. When we make material changes, we will update the effective date above and, where appropriate, notify firms through the service. Continued use after an update means you accept the revised Terms.
